Early initiation of gambling has been argued to be closely correlated with placing players at higher risk of developing problem gambling behaviour in the future. The vast majority of jurisdictions, including Great Britain, attempts to eliminate minors’ access to gambling by making it illegal and by requiring gambling providers to adopt strict age-verification procedures. Despite those measures minors continue to successfully access gambling. This paper demonstrates that British legal framework suffers from many statutory loopholes. It considers weaknesses in the regulatory offences as well as enforcement deficiencies. It further highlights how the differences between black letter law, political rhetoric and practical application undermine the strength of the prohibition of gambling by minors.

The problematic application of the precautionary principle by the European Courts has led Janssen and Van Asselt to identify patterns and inconsistencies in the Courts’ use of the principle. As a consequence, the principle runs the risk of becoming an empty tool. This paper examines new case law to determine whether these patterns have continued in the rulings of the Courts and discusses what can be done to stop the degradation of the precautionary principle.

Food producers and consumers are confronted with ever-growing choices and increasing competition within the EU and around the world. This has already led to various cases of food fraud and a call for political and legal action. Food fraud can be defined as ‘‘the deliberate and intentional substitution, addition tampering or misrepresentation of food, food ingredients or food packaging, labelling, product information, or false or misleading statements made about a food product’’. Meanwhile, the issue of “food fraud”, by means of employing names, symbols and images of third countries and thereby inducing a false impression on the consumer, appears to have been neglected despite its increasing economic impact. While the EU recently approved two new Geographical Indications (hereinafter, GIs) from third countries, the issue of the protection of Italian products against “rip–off Italian products” with Italian sounding names has taken centre–stage again.

Case C-34/10 Brüstle v. Greenpeace

1. 1. Article 6(2)(c) of Directive 98/44/EC of the European Parliament and of the Council of 6 July 1998 on the legal protection of biotechnological inventions must be interpreted as meaning that:

2. – any human ovum after fertilisation, any non-fertilised human ovum into which the cell nucleus from a mature human cell has been transplanted, and any non-fertilised human ovum whose division and further development have been stimulated by parthenogenesis constitute a ‘human embryo’;

3. – it is for the referring court to ascertain, in the light of scientific developments, whether a stem cell obtained from a human embryo at the blastocyst stage constitutes a ‘human embryo’ within the meaning of Article 6(2)(c) of Directive 98/44.

The exclusion from patentability concerning the use of human embryos for industrial or commercial purposes set out in Article 6(2)(c) of Directive 98/44 also covers the use of human embryos for purposes of scientific research, only use for therapeutic or diagnostic purposes which is applied to the human embryo and is useful to it being patentable.

5. 3. Article 6(2)(c) of Directive 98/44 excludes an invention from patentability where the technical teaching which is the subject-matter of the patent application requires the prior destruction of human embryos or their use as base material, whatever the stage at which that takes place and even if the description of the technical teaching claimed does not refer to the use of human embryos.

This special issue assembles five articles ensuing from a conference on “The Man and the Machine: When Systems Take Decisions Autonomously”, which took place on June 26 and 27, 2015, at the University of St. Gallen in Switzerland.

The aim of the conference was to explore the broader implications of artificial intelligence, machine learning and autonomous robots and vehicles. Alphabet's Deep Mind is just one example about Whom we know, at least a little, and who, we are told, will be good. Autonomous vehicles are also about to enter the market and our phones have begun to verbalize at us. Private drones are being regulated by the US Federal Aviation Administration. The five papers in this special issue address some of the legal issues the broader development raises.

Case C-404/13, The Queen, on the application of Client Earth v Secretary of State for the Environment, Food and Rural Affairs EU:C:2014:2382, OJ C – 26 of 26.1.2015, p. 6.

When a Member State finds that the limit values cannot be respected before the deadline fixed by the Air Quality Directive and wishes to postpone that deadline for a maximum of five years, that Member State is required to make an application for the postponement of the deadline by drawing up an air quality plan demonstrating how those limits will be met before the new deadline (official headnote).

An increased use of nuclear power is now accepted as inevitable by many people, but not without some unease, and the accidents at Chernobyl and Fukushima as described in the media bring little reassurance. So how dangerous is radiation exposure, for instance to those living within the influence of such accidents?

Alfalfa is one of the most important legumes used in agriculture and the fourth most cultivated plant behind corn, soybeans and wheat in the US. It has been grown in almost all federal states, occupies 9 million hectares and is primarily used in feed for dairy cows and beef cattle. US consumers also eat GM alfalfa as sprouts in salads and other foods. Roundup Ready alfalfa was developed by the agrobiotechnology firms Monsanto and Forage Genetics. It was originally approved in June 2005 for commercial sale by the US Department of Agriculture (USDA). Alfalfa is designed to tolerate the leading active substance in Monsanto’s trademark Roundup herbicide, glyphosate. It is also the first genetically modified perennial crop to be commercialized. As a result, its cultivation poses special environmental, agricultural and economic risks.

Case T-212/06, Bowland Dairy Products Ltd v. Commission

The Commission, as co-ordinator of the Rapid Alert System for Food and Feed (RASFF), is not entitled to refuse the circulation of a supplementary notification made by a Member State to the system, regardless of its own reservations about the content of that notification. This is in accordance with the non-hierarchical nature of RASFF as a form of risk information exchange envisaged in Article 50 of Regulation 178/2002. However, as the Commission itself is also a member of this network it may legitimately make notifications to the system which directly conflict with notifications made by Member States (author's headnote).

Courts in Europe increasingly acknowledge an individual right to emission reduction against states. Such a right forms a new policy tool that can be used to enforce emission reduction. It can also be used to enforce scientifically sound environmental policy, as Courts recognise science as a default position when determining the content of the right. The individual right to emission reduction is another tool in the making to consider when implementing scientific insights into policy making.

Saturday, 18 December 2010 was the first of a two day complete closure of all London area airports due to freezing temperatures and approximately five inches of snow. A week later on December 26th, New York City area airports closed in a similar manner from the sixth largest snowstorm in NYC history, blanketing the city approximately twenty inches of snow. Both storms grounded flights for days, and resulted in severe delays long after the snow stopped falling. Both London and NYC area airports produced risk communications to explain the necessity for the closures and delays. This short flash news report examines, in turn, the risk communications presented during the airport closures. A background is provided to understand how the risk perceptions differ between London and NYC publics. Finally, it compares and contrasts the perceptions of the decision making process and outcomes of the closures, which continue to accumulate economic and social impacts.
