This article reviews the way in which the concept of precaution, as commonly referenced in EU law, is received in the WTO. It argues that precaution is not a principle, but one facet of a principle of making rational judgments based on available information, the other facet of which is “that risk is worth taking”. Systematically pursuing high cost measures in response to low risks is not a balanced approach, and has probably contributed to the scepticism with which the concept is viewed in the WTO. However, this article goes on to argue that, without needing to be a principle, precaution is the determining legal feature in the SPS Agreement, because, unlike in the European Union, there is no legislative harmonisation of SPS measures at international level, WTO Members being free to set their own appropriate level of protection. In fact, the concept of precaution is relevant in the context of many other WTO provisions and is in some respects quite close to the concept of subsidiarity. Notwithstanding this, the first WTO SPS cases, driven by regulatory exporters and an interventionist WTO, have excessively emphasised scientific issues, masking policy judgments that the WTO has neither the legal nor the political authority to sustain. The article concludes that the proper way forward necessitates closer political, legal and administrative links between the WTO and other relevant international organisations, and a move away from consensus in the latter.

Information dissemination across the supply chain to consumers about chemicals’ hazardous properties and presence in consumer products has been recognized as insufficient to improve to enable both producers and end-users to avoid hazardous chemicals and to manage risks to human health and the environment. A comparative analysis of the information requirements in four EU legislations (the CLP, the Cosmetics regulation, REACH, and the Toys Safety Directive) and three US legislations (California's Proposition 65 and Senate Bill 509, and the national TSCA) was conducted with the aim of studying to what extent existing regulatory information approaches require information to be disseminated to consumers. In general, the European legislations address and promote consumers’ access to information on chemicals in products more comprehensively than the American legislations, but the amount and type of information required to be disseminated to consumers varies widely. These differences include which chemicals are prioritised, if the chemical is used in a mixture or an article, what information dissemination strategies are used, and who is responsible for consumers accessing the information. It is recommended that chemical information policies should, at minimum, require chemical suppliers to inform consumers of hazardous chemicals present in their products and, if possible, recommend risk management measures to ensure a safe use of consumer products.

Critical infrastructure (CI) sees to assets that are essential for the functioning of a society and economy, as they provide public services, enhance quality of life, sustain private profits and spur economic growth. Assets of CI differ considerably, ranging from hardware such as cables and wires, through to networks for the generation and supply of energy sources. Critical infrastructures encompass many sectors of the economy, such as banking and finance, transport and distribution, energy, utilities, health, food supply and communications, aswell as key government services.

The SPS Agreement may apply to budgetary measures if they are motivated by SPS concerns. Equivalence-based measures are subject to regular disciplines of the SPS Agreement, including but not limited to Article 4. This means that WTO Members when engaging in the recognition process need to observe other SPS provisions such as requirement of scientific risk assessment (Articles 5.1–5.3) or quasi-consistency obligation of Article 5.5. An SPS measure which has been found inconsistent with certain provisions of the SPS Agreement (e.g. Articles 2 and 5), cannot be later justified under the general exception of Article XX(b) of the GATT 1994 (author's headnote).

This article deals with complex systems. It takes the reader on a journey to the origins of the paradigm shift which has taken place in the sciences since the path breaking works of Edward N. Lorenz, Benoît B. Mandelbrot, Mitchell J. Feigenbaum, and others. Gradually, linear “twodimensional” thinking has been replaced by non-linear “multi-dimensional” reasoning and multi-factorial genesis, risk, and uncertainty have come into focus. The article looks at the beginnings of the conception of complex systems — chaos theory — and reveals the implications for the law and legal science. Having explained the premises of chaos theory by means of a metaphor (the kneading of dough) the article proposes to look at the law through the lens of chaos: the law, especially case law, is perceived as a system which is itself subject to the phenomenon of chaos. The power of the image of chaos is illustrated by means of a study of the case law of the European Court of Justice on family reunification of moving persons and its projection to Switzerland in an attempt to create parallel regimes. The article also takes advantage of chaos theory to portray the broader implications for society and the law, tentatively illustrating them by thoughts on the Lisbon judgment of the German Federal Constitutional Court of 30 June 2009 and on UN Security Council Resolution 1244 of 10 June 1999 (on Kosovo).

Legislation passed by the Scottish Parliament in June 2012 to impose minimum unit pricing for alcohol sold in Scotland as part of a strategy to tackle alcohol-related harm has yet to be implemented pending the outcome of a challenge to its legality under EU law before the Scottish Courts brought by three associations of producers of wines and spirits, namely the Scotch Whisky Association, the Confédération Européenne des Producteurs de Spiritueux and the Comité de la Communauté économique européenne des Industries et du Commerce des Vins, Vins aromatisés, Vins mousseux,Vins de Liqueur et autres Produits de la Vigne. The first instance court in Scotland rejected the challenge in May 2013, but Scotland's appeal court decided in April 2014 that before ruling on the producers’ appeal, it should refer a number of questions to the Court of Justice of the European Union (“CJEU”). The CJEU is not expected to rule until late 2015 at the earliest and so the ultimate outcome before the Scottish courts is not likely to be known until 2016.

This section discusses the regulation of “lifestyle risks”, a term that can apply to both substances and behaviours. Lifestyle risks take place along the line of “abstinence – consumption – abuse – addiction”. This can concern substances such as food, alcohol or drugs, as well as behaviours such as gambling or sports. The section also addresses the question of the appropriate point of equilibrium between free choice and state intervention (regulation), as well as the question of when risks can be considered to be acceptable or tolerable. In line with the interdisciplinary scope of the journal, the section aims at updating readers on both the regulatory and the scientific developments in the field. It analyses legislative initiatives and judicial decisions and at the same time it provides insight into recent empirical studies on lifestyle risks.

European law of risk regulation is commonly intended to be limited to the European regulation in the internal market. However, risk is also regulated in Europe by human rights law, which is often left aside in this area. In fact, disregard for the risk entailed by certain manmade activities as well as by natural events, may imply restrictions to, inter alia, the right to life and the right to respect for private and family life enshrined in the European Convention on Human Rights. This article aims at studying the manner in which this Convention regulates risk through human rights norms. It provides an overview of the standards set by the European Court of Human Rights in this field.

On 20 July 2016, a new legal framework comes into effect for the so-called “food for specific groups”, established by Regulation (EU) No. 609/2013 on food intended for infants and young children, food for special medical purposes, and total diet replacement for weight control (hereinafter, FSG Regulation). The FSG Regulation repeals Directive 2009/39/EC on foodstuffs intended for particular nutritional uses (hereinafter, the PARNUTS Directive). Food intended for sportspeople placed on the market will be affected by the repeal of the PARNUTS Directive as such food has not been included in the FSG Regulation's scope and will have to comply with general EU food law from 20 July 2016. This has a major impact on compositional requirements, product names and claims made on such food. Inter alia, the possibility to make so-called “suitability statements” on food intended for sportspeople, which currently does give manufacturers some margin to make statements that some consider as something similar to claims, is likely to be controversial without the PARNUTS Directive.
