It was with great sorrow that the ICRC heard of the demise on 11 December 1984, at age 81, of Mr. Francois de Reynold, former ICRC Head of Protocol.

Mr. de Reynold, a law graduate of Fribourg University, joined the Italian Service of the Central Agency for Prisoners of War on 1 April 1943. In January 1945, he was transferred to the ICRC Liaison Service which later became the Liaison and Protocol Service.

In a letter dated 27 May 1977, Mr. Mierre Micheli, member of the International Committee of the Red Cross, tendered his resignation from the ICRC for health reasons, with effect from 1 June.

Armed forces have for many years developed new methods of observation in order to increase their capacity to fight at any time of day or night and in any weather conditions. Some have thus equipped themselves with thermal imaging or infrared (IR) cameras, which make it possible to recognize and detect people and objects not only at night but also in poor daytime visibility conditions (for example, through smoke, foliage or light rain).

The condition of cultural property through the armed conflicts which have succeeded one another from Antiquity to the eve of the Second World War is no easy subject to study.

The sources available have of course made it possible to establish that from the latter part of the nineteenth century onwards, domestic and international laws have been enacted to reduce somewhat rather than prevent damage to cultural property during hostilities.

As cash increasingly becomes an essential part of humanitarian assistance, it is critical that practitioners are aware of, and work to mitigate, exposure to protection risks among the most vulnerable recipients. This article presents findings from qualitative research exploring protection risks and barriers that arise in cash programming for internally displaced persons at high risk of violence and exploitation in Cameroon and Afghanistan. The authors conclude with recommendations for mainstreaming global protection principles into cash programmes, as well as key considerations for designing and implementing cash programmes in ways that minimize existing risks of harm and avoid creating new ones.

Using evidence from nine different National Societies, this essay illustrates how the Fundamental Principles of the Red Cross and Red Crescent Movement are practically applied in today's diverse contexts. The research has found that the Principles are not just abstract concepts but are in fact practical tools for initiating and implementing a range of programmes, particularly in difficult situations. The Fundamental Principles are useful for increasing access in both conflict and peaceful situations. Strong leadership is an important factor to ensure that the Principles are applied, particularly when neutrality is challenged. Lastly, all seven Principles work together and give additional strength to programmes when working as part of the Movement.

This article aims to determine what important new developments have emerged in reparation for victims of serious violations of international humanitarian law (IHL). Our hypothesis is that there have been significant new developments in this area of particular relevance to IHL and that reparation for victims of serious violations of IHL is increasingly being incorporated into this body of law as one of its key components. It is submitted that the following developments are evidence of this gradual transformation of IHL: (i) broad recognition of the right of victims of serious violations of IHL to reparation; (ii) extension of the scope of the obligation to provide reparation under IHL to include non-State armed groups and individuals as well as States; (iii) the existence of innovative domestic reparation mechanisms complemented or supervised by regional courts, as evidenced by experiences in Latin America; and (iv) the reparation system of the International Criminal Court as a global mechanism.

The 9/11 attacks and the “War on Terror” brought terrorism and counterterrorism to the forefront of politics. Today, terrorism remains one of the most serious threats to national and international security. Yet, amid the surge of scholarly and policy interest in terrorism and counterterrorism, the literature on counterterrorism policies and strategies in the Middle East at the local and regional levels is sparse, limited and predominantly Western.

The experience of political terrorism and violence in the Middle East throughout the 1980s and 1990s, which led to the introduction of a securitization process and the adoption of counterterrorism measures in the region long before the 9/11 attacks, offers important lessons. This paper takes its point of departure from the definitional conundrum of the concepts of “terrorism” and “(national) security” within the Middle East context. It examines the evolution of the securitization process in the Middle East in response to terrorism, with reference to the experiences of countries in the region. As it analyzes the different counterterrorism models and methods employed, it argues that counterterrorism strategies in much of the Middle East have not been effective and have at times been counterproductive.

When large numbers of people die as a result of humanitarian emergencies, their bodies and remains are often managed with little consideration for their dignity. This may impact the capacity to identify the deceased and prevent them from becoming missing persons. Many of the existing guidelines for managing the dead in emergencies, including those published by the International Police Organization, the World Health Organization and the International Committee of the Red Cross, are accomplished from a technical point of view, but offer little or no specific guidance on guaranteeing respect for the deceased and their remains. In 2018, the Missing Persons Project of the International Committee of the Red Cross and the Right to Truth, Truth(s) through Rights project of the University of Geneva convened a meeting of experts to discuss the need for developing guidance to guarantee the dignified treatment of the dead in humanitarian emergencies. Participants identified the need worldwide for a set of general principles to guide practitioners and decision-makers in their efforts to ensure respect for dead persons and human remains in humanitarian emergencies, and recommended their development.

Discrimination and sexual and gender-based violence committed against lesbian, gay, bisexual, transgender, queer and intersex (LGBTQI) detainees remains one of the most pressing contemporary humanitarian challenges. This article focuses on the interpretation of the phrase “or any other similar criteria” as contained in Article 3 common to the four Geneva Conventions, upon which adverse distinction is prohibited, in order to qualify sexual orientation and gender identity as prohibited grounds of adverse distinction. The interpretation of “or any other similar criteria” will be embarked upon by employing the general rule of treaty interpretation provided for in the Vienna Convention on the Law of Treaties, so as to qualify sexual orientation and gender identity as “any other similar criteria” and ultimately to realize the protection of LGBTQI detainees against discrimination and sexual and gender-based violence during non-international armed conflict.

This opinion note explores some aspects of the relationship between humanitarian non-governmental organisations (NGOs) and extractive industries. Médecins sans Frontières (Doctors without Borders, MSF) has endorsed a policy of non-engagement with the corporate sector of the extractive industries, particularly when it comes to financial donations. This is coherent with MSF being first and foremost a medical organisation, and one that adheres to the humanitarian principles of independence and neutrality. For humanitarian actors, the prospect of future environmental disasters and environmental conflicts calls for the anticipation of novel encounters, not only with environmental organisations but also with the extractive sector. Unlike environmental organisations, extractive industries are prone to generating or perpetuating different forms of violence, often putting extractive companies on a par with the parties to armed conflicts. In situations where a dialogue with extractive companies would be needed to optimise care and access to victims, humanitarian organisations should carefully weigh pragmatic considerations against the risk of being co-opted as medical providers of mitigation measures.

This article invites the reader on a journey through the legal arguments that would confirm the application of the United Nations (UN) climate change regime to belligerent occupations. Although the regime is silent on this issue, its application should not be limited to peacetime due to the seriousness of global climate change and its adverse effects on the environment and living entities. A harmonious interpretation and application of the UN climate change regime and the law of occupation would allow Occupying Powers to ensure the safety and well-being of the civilian population and contribute to the protection of the Earth's climate system.

This article briefly overviews some of the current and future challenges to NATO legal interoperability arising from the relationship between international humanitarian law (IHL) and international human rights law generally and between IHL and the European Convention on Human Rights in particular.

International humanitarian law, whose purpose is to attenuate the evils of war, has been intimately bound from its earliest days to doctors and all others whose mission in life is to heal—the noblest of all professions. The fact is that this law originated from the need to make up for the deficiencies of military medical services and protect those wounded in war. Since then, the law has gone far beyond that framerwork and has extended its protection and solicitude to many other victims of conflicts and also, in peacetime, to victims of day-to-day life—sick people. An essentially medical element was the basis of the law, and continues to be a major element, referred to by some as “medical law”.

As one of the leaders of the Polish workers, Lech Walesa was detained several times during the 1970s. He led the shipyard strike and later negotiated the Gdansk agreement of 31 August 1980. In December 1981, Walesa, along with several thousand others, was arrested when General Jaruzelski imposed martial law and “suspended” the labour movement “Solidarnosc” (Solidarity). Walesa was interned in a country house in a remote part of Poland, close to the then Soviet border, and was visited three times by ICRC delegates. During this period, the ICRC visited 4,850 other internees (79 visits to 24 different places of detention) and it provided assistance and helped to restore contact between internees and their families abroad. At the same time and in conjunction with the Polish Red Cross and the League of Red Cross and Red Crescent Societies (as it was then known), the ICRC carried out an extensive assistance programme for the benefit of the civilian population which was in dire need of basic goods.

In a sporadic way since 1919, then systematically from the late 1960s, the ICRC has endeavoured to carry out its humanitarian activities in situations of internal disturbances and tensions, in particular to give protection and assistance to persons imprisoned in such circumstances and commonly referred to as “political detainees”.

The ICRC's rules of conduct in such situations were presented at the Twenty-third International Conference of the Red Cross (Bucharest, 1977) as part of the document entitled “The ICRC, the League and the Report on the Re-appraisal of the Role of the Red Cross”.
