The “asymmetry myth” is that war crimes are committed by one's enemies but never, or hardly ever, by one's own combatants. The myth involves not only a common failure to acknowledge our own actual war crimes but also inadequate reactions when we are forced to recognize them. It contributes to the high likelihood that wars, just or unjust in their causes, will have a high moral cost. This cost, moreover, is a matter needing consideration in the jus ante bellum circumstances of preparedness for war as well as of conduct within it. As part of the symposium on Ned Dobos's book, Ethics, Security, and the War-Machine, I will argue that the strength of the asymmetry myth is sustained by certain forms of romantic nationalism linked to the glamorization of military endeavor.

In his article “Carbon Emissions, Stratospheric Aerosol Injection, and Unintended Harms,” Christopher J. Preston compares the culpability of carbon emitters versus that of geoengineers deploying stratospheric aerosol injection (SAI). This comparison relies on a parallel between carbon emitters and SAI deployers that requires both to be agents. However, both are not. While the harms of geoengineering will be caused by culpable agents acting intentionally, the harms connected to climate change emerge out of the uncoordinated actions of billions of people. Taken as a large group, carbon emitters cause harm but do not constitute an agent. Taken individually, carbon emitters are agents but do not cause the harms of climate change. As a result, the parallel collapses, and Preston's “surprising” conclusion is one that he is not entitled to reach.

We have the power of choice over nuclear weapons. But we do not feel our power. Instead, we feel their power. They are larger than life. They loom over us, seemingly beyond our control, shrouded in myth and dark mystery. Because of their power and our feeling that nuclear weapons are unique, we believe that these weapons require a special set of moral rules, specially tuned to the separate world where nuclear weapons dwell.

Hans J. Morgenthau is generally considered to have been a political realist and the transmitter of continental Realpolitik into American letters. But he has also been claimed as an idealist, as a constructivist, and as an ethicist. Some of these claims make sense if we understand that Morgenthau was trained as a lawyer in the German historical tradition. Others can be made sense of if we understand that—self-consciously a “European”—he was continuously adapting his ideas to an American audience and, in the process, being socialized into an American experience. The essays in this roundtable illustrate the “Americanization” of Morgenthau.

It might seem an American Dream come true: About 100 Massachusetts Institute of Technology professors, ten at a time, are managing five laboratories stocked with “totally state-of-the-art equipment” in a gleaming new tower on the National University of Singapore campus. As the New York Times reports, the campus houses the Singapore-MIT Alliance for Research and Technology and other projects, involving “world-class universities from Britain, China, France, Germany, Israel and Switzerland.” The MIT professors and their forty PhD and postdoctoral researchers are designing “myriad innovations”: driverless cars that would respond to “killer app” sensors throughout Singapore; stingray-like robots that will collect ocean-bottom data to fight noxious algae; and technologies that will track infectious diseases, energy consumption, and other movements in this tightly run, wealthy city-state of 5.4 million people.

The events of September 11 have forced institutions to reexamine their priorities and practices. Yet the first world war of the twenty-first century has left many wondering if there truly is a war, and what, if anything, different is demanded of them. The philanthropic sector in particular has not changed significantly, and it continues to struggle with fundamental concerns about its directions. If September 11 and its aftermath are to mean anything to philanthropy other than emergency relief, it must be a recognition that now is the time to tackle the problems and tensions that were ignored before the attacks. For nearly a year, philanthropy as a sector has not rallied behind this call for longer-term reform. Philanthropy should take up these tasks, no matter how daunting they may be, for if foundations do not lead the effort, it may be left to the governments and the militaries of the world to respond on their own.

One of the more striking, surprising, and optimism-inducing features of the contemporary international system has been the decline of interstate war. The key question for students of international relations and comparative politics is how this happy state of affairs came about. In short, was this a universal phenomenon or did some regions play a more important and pioneering role in bringing about peaceful change? As part of the roundtable “International Institutions and Peaceful Change,” this essay suggests that Western Europe generally and the European Union in particular played pivotal roles in transforming the international system and the behavior of policymakers. This helped to create the material and ideational conditions in which other parts of the world could replicate this experience, making war less likely and peaceful change more feasible. This argument is developed by comparing the experiences of the EU and the Association of Southeast Asian Nations and their respective institutional offshoots. The essay uses this comparative historical analysis to assess both regions’ capacity to cope with new security challenges, particularly the declining confidence in institutionalized cooperation.

This essay seeks to consider Anna Stilz's Territorial Sovereignty: A Philosophical Exploration in light of settler and nonsettler colonialism and their contemporary legacies. In particular, it examines the intergenerational claims of Indigenous communities and the extraterritorial claims of colonial and neocolonial subjects. The broad aim of this effort is to consider how centering the imperial roots of our contemporary nation-state system transforms our understanding and justifications of territorial sovereignty.

The ethical value of intelligence lies in its crucial role in safeguarding individuals from harm by detecting, locating, and preventing threats. As part of this undertaking, intelligence can include protecting the economic well-being of the political community and its people. Intelligence, however, also entails causing people harm when it violates their vital interests through its operations. The challenge, therefore, is how to reconcile this tension, which Cécile Fabre's recent book Spying through a Glass Darkly does by arguing for the “ongoing and preemptive imposition of defensive harm.” Fabre applies this underlying argument to the specifics of economic espionage to argue that while states, businesses, and individuals do have a general right over their information that prevents others from accessing it, such protections can be forfeited or overridden when there is a potential threat to the fundamental rights of third parties. This essay argues, however, that Fabre's discussion on economic espionage overlooks important additional proportionality and discrimination concerns that need to be accounted for. In addition to the privacy violations it causes, economic espionage can cause harms to people's other vital interests, including their physical and mental well-being and autonomy. Given the complex way in which the economy interlinks with people's lives and society, harms to one economic actor will have repercussions on those secondary economic entities dependent on them, such as workers, buyers, and investors. This, in turn, can produce further harms on other economic actors, causing damages to ripple outward across society.

This essay weaves together the history of political and legal thought, contemporary democratic theory, and recent debates in legal scholarship to examine the ambivalent relationship between political parties and democracy. Celebrated as a structural necessity for the mechanics of democratic government, political parties are also handled with suspicion for their hybrid nature—neither entirely public nor completely private—and for their always-possible regression into factions. Anti-factionalism, I show, has been a powerful ideal driving constitutional imagination and practice over the centuries, from antiquity (with its emphasis on parts and its horror over factions), to the age of democratic revolutions (with its signature anxieties about divisions), up through the present. However, this long historical process has not extinguished the long-lived concern with the nature and implications of party spirit, nor has it made party democracy completely safe from revamped forms of factionalism. Two manifestations of factional politics stand out in the contemporary political landscape: authoritarian regime changes and populist constitutionalism. While the former is easy to diagnose but hard to prevent, the latter exemplifies a torsion of the constitutional and democratic imagination from within. Despite their differences, both scenarios remind us that constitutions need to envision mechanisms to prevent parties from undermining the liberal democratic order they have been designed to serve. At the same time, they call for renewed attention to the study of parties in the domains of democratic theory and constitutional scholarship.

Climate change challenges the means of subsistence for many, particularly in the Global South. To respond to the challenges of climate change, countries increasingly resort to resettling those most affected by land erosion, heat, drought, floods, and the like. In this article, I investigate to what extent resettlement can compensate for the harm that climate-induced migration brings. The first harm I identify is that to individual autonomy. I argue that climate change changes the options of those affected by it to the point that the decision to migrate can no longer count as a voluntary one. In some cases, I argue, the conditions of climate change coerce individuals. Second, I suggest that climate-induced migration severs the ties to territory, explaining the constitutive nature of such ties for accounts of individual autonomy. Third, I argue that severing ties with a traditional and historical territory challenges the capacity to imagine a future for individuals. I conclude that resettlement, even if actively planned and chosen, possibly providing gains in individual well-being and human flourishing, nevertheless harms individual autonomy interests.

Exploitation of the executive exercise of covert operations has presented a dilemma, but Colby maintains that even in peacetime a “democratic society must have and respect some secrets.” Does democracy, by its inherent nature, preclude the employment of covert action, even under exceptional conditions? Colby argues that the constitutional decision-making process is an ethical and legal one. In wartime, a “just” war is the goal, and the use of covert action must be evaluated by two essential criteria: self-defense and proportionality to the act requiring self-defense.
