  • Business and Human Rights in Russia: Emerging or Merging?

  • The increasing focus on business and human rights (BHR) in civil society and policymaking has not been matched by research on corporate actions to respect and protect human rights. The lack of research on BHR is especially acute outside of Western Europe and Anglo-centric contexts. This paper seeks to investigate how the largest Russian firms conceptualize and fulfil their human rights obligations under the UN Guiding Principles and the extent to which internationalization of those firms may have impacted these behaviours. I use a unique dataset created from a sample made of the 100 largest firms listed on the Moscow Stock Exchange. Using the theoretical construct of institutional conflict, I find that cross-listing on other stock exchanges and the extent to which firms frame their broader social responsibility issues as ‘sustainability’ or ‘sustainable development’ rather than ‘corporate social responsibility’ has a substantial impact on firm attention to human rights. While this attention is encouraging, firm disclosure of actions taken to mitigate against violations and protect human rights is extremely limited and the strength of domestic institutional pressures has resulted in very little firm action in the face of the extreme and widespread human rights violations being committed in Ukraine by Russia.

  • Emerging Regulations on Content Moderation and Misinformation Policies of Online Media Platforms: Accommodating the Duty of Care into Intermediary Liability Models

  • Disinformation, hate speech and political polarization are evident problems of the growing relevance of information and communication technologies (ICTs) in current societies. To address these issues, decision-makers and regulators worldwide discuss the role of digital platforms in content moderation and in curtailing harmful content produced by third parties. However, intermediary liability rules require a balance that avoids the risks arising from the circulation at scale of harmful content and the risks of censorship if excessive burdens force content providers to adopt a risk-averse posture in content moderation. This piece examines the trend of altering intermediary liability models to include ‘duty of care’ provisions, describing three models in Europe, North America and South America. We discuss how these models are being modified to include greater monitoring and takedown burdens on internet content providers. We conclude with a word of caution regarding this balance between censorship and freedom of expression.

  • Since 2017, the government of the People’s Republic of China has heightened repression of Uyghur and other minorities in the Xinjiang Uyghur Autonomous Region (XUAR). Repressive tactics involve family separations, mass incarceration, forced labour and cultural indoctrination. This has been accompanied, in recent years, with an aggressive industrialization of the area which relies heavily on the forced labour of Uyghur and other minorities. The automotive industry, in particular, has expanded into the region. This piece describes China’s push of heavy industry into XUAR and recent findings by Sheffield Hallam University and NomoGaia of abuses against Uyghurs and their links to the global automotive sector. It then explains the methodology employed by NomoGaia in its co-authored report with scholars from Sheffield Hallam University for linking abuses in the XUAR to global brands, and proposes a way forward for the industry.

  • Coca-Cola’s Cape Town Crisis: Examining Companies’ Water Rights Obligations in a Changing Climate

  • While Coca-Cola portrays itself as a ‘water neutrality’ leader, its failures during Cape Town’s water crisis exemplify the changing nature of corporate human rights obligations in the face of climate change. Between 2015 and 2018, drought conditions plunged Cape Town into a crisis, leading to increasingly strict household water restrictions and depriving families of their constitutionally guaranteed water allowance.1 However, in December 2017, when Cape Town officials called for a 45% reduction in commercial water use, Coca-Cola’s local independent bottler – Coca-Cola Peninsula Beverages (CCPB) – refused to reduce its 44 million-litre monthly withdrawals.2 The city subjected households to water restrictions and price increases up to 556%, while businesses only saw a 104% price increase with no consumption restrictions.3

  • Corporate-led women’s empowerment initiatives appear, in their proactiveness, to be a welcome addition to a range of measures addressing adverse human rights impacts by business. This article questions the claim that these projects significantly advance women’s rights. Instead, they can be understood as a manifestation of what Catherine Rottenberg terms ‘neoliberal feminism’ with women at risk of being transformed into ‘gender capital’ for business gain. This article rejects the claim that empowerment can only be delivered by encouraging women into market-based work. Instead, it is argued that the corporate responsibility to respect the human rights of women can better be supported by reorienting business away from its preoccupation with delivering value for shareholders, towards an approach that values women’s unpaid socially reproductive labour.

  • The South African Experience: Litigating Remedies

  • Many transnational corporations (TNCs) that conducted business in South Africa during apartheid had deemed it profitable and desirable, despite the country’s systemic human rights violations against its majority black population. In the aftermath of the 1960 Sharpeville Massacre and 1976 student uprising, various United Nations and other international resolutions condemned TNCs for their incestuous relationship with apartheid South Africa and called for international sanctions against the regime. The demise of apartheid in 1994 brought about a new democratic, constitutional dispensation based on respect for human rights. However, attempts at holding TNCs liable for aiding and abetting the apartheid regime were fraught with obstacles and proved unsuccessful. Yet, the pursuit of strategic, class action litigation in areas as diverse as collusive conduct in bread manufacturing to occupational lung disease in South Africa’s goldmining industry have proven to be more successful in developing legal remedies against corporate harm. Areas impacted are extended legal standing under the common law, development of new causes of action and generous application of contingence fees arrangement.

  • After the unanimous endorsement of the UN Guiding Principles on Business and Human Rights (UNGPs) by the Human Rights Council in June 2011, human rights due diligence (HRDD) has become a common currency widely embraced among stakeholders operating in the business and human rights (BHR) field. The UNGPs envisage HRDD to be the primary tool for businesses to identify, prevent, mitigate and account for adverse impacts of their activities on internationally recognized human rights.
