Particularly in the context of East and Southeast Asia, the notion of ‘socialism’ and ‘socialist’ is commonly but mistakenly attached to a wide diversity of legal practices that this chapter argues actually have nothing to do with socialism. In order to preserve the particular insight that is captured by the idea of socialism – namely, the particular social dominations that capitalism imposes on laboring classes and the ways this can be rectified – we would do well to only attach that idea to legal practices that advance that insight. As shall be shown, most of the practices that are commonly described as being a part of a ‘socialist legality’ in the context of East and Southeast Asia fail this test, and in fact many can be and are frequently used to perpetuate the very kinds of capitalist dominations that socialism itself opposes.
